Welcome to Aiua. These Terms of Service ("Terms") form a binding legal agreement between you ("you," "User") and Aiua LLC, a Wyoming limited liability company ("Aiua," "we," "us," "our"), governing your access to and use of the Aiua platform, including the website at aiua.earth, the Aiua mobile application, the Aiua Archive dataset, and any related services (collectively, the "Platform").
Please read these Terms carefully. By creating an account, accessing the Platform, or submitting any content, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Platform.
These Terms include important provisions affecting your legal rights, including:
Aiua is a guided daily self-reflection platform. Users compose reflections in response to community prompts. Reflections are scored by artificial intelligence across 12 human-values dimensions and, when explicitly shared by the user, released under the Creative Commons CC0 1.0 Universal Public Domain Dedication to form an open dataset for artificial intelligence alignment research (the "Aiua Archive").
Aiua is a reflection and journaling tool. It is not a mental health service, medical service, therapeutic service, legal service, financial advisory service, or professional advisory service of any kind. It does not diagnose, treat, cure, prevent, or mitigate any condition.
To use the Platform, you represent and warrant that:
We reserve the right to verify eligibility and to refuse or terminate accounts that do not satisfy these requirements.
You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account. Notify us immediately at [email protected] if you suspect unauthorized access. Account sharing is not permitted. We are not liable for losses arising from your failure to safeguard your credentials.
By submitting any contribution, you represent and warrant that:
Submission alone does NOT release your contribution under any public license. A qualifying score (50 or above out of 100) makes a reflection eligible to be shared, but sharing is a separate, per-contribution action you must take affirmatively.
After scoring, you see three distinct choices:
The CC0 release is irrevocable. When you choose to share, you irrevocably waive, to the maximum extent permitted by applicable law, all of your copyright and related rights worldwide in that contribution. Anyone, anywhere, for any purpose, may copy, modify, distribute, perform, and otherwise use the shared contribution, including for commercial purposes, without your permission and without compensation.
Once a contribution is anchored to the Cardano blockchain and archived to Arweave, it cannot be deleted, modified, or recalled. This is permanent and irreversible by design. You may request removal of a shared contribution from Aiua-operated surfaces (the website, dataset distribution) within 7 days of sharing by emailing [email protected]. After 7 days, contributions may be anchored to public blockchains and become permanently distributed; copies that have already been exported, downloaded, anchored on-chain, or archived to Arweave cannot be retracted by anyone, including Aiua.
Notwithstanding the irrevocability of the CC0 release, Aiua reserves the right at its sole discretion to remove published contributions from its own operated platforms (the website, dataset distribution from Aiua-controlled servers) in response to valid legal demands, court orders, applicable law, child-safety obligations, or operational necessity. The CC0 release imposes no obligation on Aiua to host or distribute any specific contribution. This right does not extend to copies already distributed to third parties or anchored to public blockchains.
Contributions you keep private (whether in the server-side Journal or client-side Vault) are never released under CC0, regardless of score. Vault entries are end-to-end encrypted and are never included in any dataset export. To release a Vault entry under CC0 you would have to explicitly promote it to Archive, sending the plaintext through the standard sharing flow.
Your username is not included in the public dataset. Contributions in the Aiua Archive are identified by an anonymous UUID. You are solely responsible for any personal details you choose to include in your contribution text. Aiua does not redact or anonymize the substance of contributions you choose to share.

Violations will result in contribution removal and may result in account suspension or permanent ban without prior notice.
The Platform generates AI output across multiple surfaces, including but not limited to scoring, written feedback, Go Deeper questions, dream interpretation, the Jane chat agent, the Fantasy Game, and any advisor or assistant features (collectively, "AI Output").
You acknowledge and agree that:
Every AI-generated surface on the Platform is labeled or otherwise identifiable as AI-generated, in compliance with applicable transparency requirements including but not limited to Article 50 of the European Union Artificial Intelligence Act.
Writing reflections, particularly on difficult or painful subjects, may surface strong emotions including sadness, grief, anger, frustration, anxiety, or regret. This is an expected part of reflective practice.
You agree that you are solely responsible for your own emotional wellbeing during use of the Platform. We encourage you to:

The Platform employs automated safety classifiers that screen contributions and AI-mediated interactions for signals of crisis, including suicidal ideation, self-harm intent, and threats toward others. These classifiers are imperfect and may produce false positives or false negatives.
When the safety classifier identifies content as urgent:
Automated crisis detection is not a substitute for professional crisis intervention. If you or someone you know is in immediate danger, call emergency services in your jurisdiction or contact a crisis hotline. See find-a-helpline.com for international resources.
Aiua does not represent that its safety classifier will detect all crisis content, will respond in real-time to all situations, or will prevent any specific harm. The classifier is a supplemental safeguard, not a guarantee.
Points are awarded when you share a qualifying contribution with the Aiua Archive. Sharing to Archive awards your contribution's score as points; sharing to Archive plus Community Feed awards score points plus a small bonus. Keeping a contribution private earns zero points. Additional points may be awarded for referrals, streaks, and governance participation as described on the Platform.
Points have no monetary value, are not redeemable for cash or any cash equivalent, and do not represent any property right, security, ownership interest, or claim against Aiua. Points and gems may be adjusted, reduced, or revoked at our discretion for violations of these Terms or for operational reasons.
Tiers are determined by accumulated points and unlock certain Platform features. Tiers are not a property right. Tier features may change, be added, removed, or modified at any time.
A governance token does not currently exist. No promise, representation, or guarantee is made that any governance token will be created, distributed, or have any value.
If a governance token is launched in the future, it is designed and intended as a governance and utility instrument for participation in platform decision-making by community members. Aiua makes no representation that the governance token will have monetary value, that any market for it will exist or persist, or that any specific regulatory characterization applies in your jurisdiction.
You acknowledge that:
Nothing on the Platform constitutes investment advice, financial advice, legal advice, tax advice, or a solicitation, offer, or recommendation to purchase any security, digital asset, or financial product.
Anthropic, the Cardano Foundation, and any other third-party services referenced on the Platform are not affiliated with, endorsing, or sponsoring any future governance token.
Donations to Aiua are voluntary and non-refundable. Donations fund Platform operations and are not investments, do not grant equity, do not grant governance rights, and do not entitle the donor to any future tokens, revenues, or other consideration.
The Platform's source code, design, branding, trademarks, written content (other than user contributions), and other proprietary materials are owned by or licensed to Aiua. Nothing in these Terms transfers any right, title, or interest in such materials to you, except for the limited right to access and use the Platform in accordance with these Terms.
As described in Section 5.2, contributions that you affirmatively choose to share are released under CC0 1.0 Universal. You retain no copyright in shared contributions. Contributions that you keep private remain subject to your copyright; Aiua's right to operate the Platform on your private content is described in Section 9.
If you provide feedback, suggestions, ideas, or other input about the Platform ("Feedback"), you grant Aiua a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use, modify, and incorporate the Feedback into the Platform and related products without attribution or compensation.
If you believe content on the Platform infringes your copyright, please contact [email protected] with details of the allegedly infringing material and your basis for the claim. We will review in good faith and respond. Repeat infringers will have their accounts terminated.
To operate the Platform, you grant Aiua a limited, non-exclusive, worldwide, royalty-free license to host, store, transmit, display, reproduce, and process your contributions (including private contributions) solely to provide the Platform and its features to you. This license does not grant Aiua any right to publish private contributions outside the Platform's normal operation. This license terminates when you delete the contribution or close your account, subject to any retention required by applicable law.
Your use of the Platform is governed by our Privacy Policy, available at aiua.earth/privacy, which is incorporated into these Terms by reference.
Depending on your jurisdiction, you may have rights regarding your personal data, including:
These rights are available to users in jurisdictions including the European Economic Area (under the General Data Protection Regulation), the United Kingdom (under the UK Data Protection Act), California (under the California Consumer Privacy Act and California Privacy Rights Act), Brazil (under the Lei Geral de Proteção de Dados), and other jurisdictions with similar regimes.

Aiua takes commercially reasonable measures to protect your personal data. In the event of a confirmed data breach involving your personal data, we will notify affected users without undue delay, and in any event within 72 hours of confirmation, where required by applicable law. Notification will describe the nature of the breach, the categories of data affected, the likely consequences, and the measures being taken in response.
You acknowledge that no system is perfectly secure and that Aiua cannot guarantee against all forms of unauthorized access, disclosure, alteration, or destruction of data. You also acknowledge that encrypted Vault entries may become permanently inaccessible if encryption keys are lost.
You may delete your account at any time by contacting [email protected] or using any in-Platform deletion feature. Personal data associated with your account will be removed from Aiua-controlled systems within 30 days, subject to legal retention requirements and the irreversibility of any contributions you previously chose to share publicly under CC0.
We may suspend or terminate your account, with or without notice, for any violation of these Terms, suspected fraud or abuse, legal compliance, or for operational reasons. Published contributions released under CC0 remain in the public dataset following termination.
Upon termination, your right to access the Platform ends immediately. Sections that by their nature should survive termination (including Sections 5.2, 5.5, 8, 12, 13, 14, 15, 16, 17, 18, 19, and 20) survive termination.
The Platform integrates with third-party services, including but not limited to:
Use of third-party services is subject to those services' own terms and privacy policies. Aiua is not responsible for the availability, accuracy, content, security, performance, or practices of third-party services.
When you provide your own API key for a supported third-party AI provider, your use of that provider's services is governed by the provider's own terms of service and acceptable-use policies. Aiua operates as a pass-through proxy: we transmit your prompts and the provider's responses, but we do not warrant, endorse, or take responsibility for the provider's output, billing, data practices, content policies, or availability.
Any claim arising from a third-party AI provider's output, conduct, or business practices is solely between you and that provider. Aiua disclaims all liability for third-party-provider matters to the maximum extent permitted by applicable law.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION.
Without limiting the foregoing, Aiua does not warrant:

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL AIUA, ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, EMOTIONAL DISTRESS, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE PLATFORM, EVEN IF AIUA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
AIUA'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU HAVE PAID TO AIUA IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages; in those jurisdictions, the foregoing limitations apply to the maximum extent permitted by law.
You agree to defend, indemnify, and hold harmless Aiua and its officers, directors, employees, contractors, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
This indemnification obligation will survive termination of these Terms and your use of the Platform.
Aiua is committed to making the Platform accessible to people with disabilities. We strive to follow the Web Content Accessibility Guidelines (WCAG) 2.1 at the AA conformance level as a target standard. The Platform is an evolving product and accessibility is an ongoing effort.

We may update these Terms from time to time. For material changes, we will provide at least 14 days' notice via email to your registered address or via a prominent in-Platform notification before the changes take effect. Non-material changes (clarifications, typo corrections, formatting) may be made without notice and will be reflected in the Last Updated date.
Continued use of the Platform after the effective date of any update constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Platform.
Prior versions of these Terms are archived and accessible at aiua.earth/terms/archive. When you create your account, the version of these Terms then in effect is recorded; that version is available to you at any time via your account settings.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
These Terms are governed by the laws of the State of Wyoming, United States of America, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Except for claims for injunctive or equitable relief regarding intellectual-property rights (which may be brought in court), any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) in accordance with its applicable rules then in effect.
The seat and venue of arbitration shall be Cheyenne, Wyoming. The arbitration shall be conducted in English. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
YOU AND AIUA AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.
Unless both parties agree otherwise, the arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding. If this class-action waiver is found unenforceable, then the entirety of Section 19.2 (Binding Arbitration) shall be null and void with respect to the claim that gave rise to such unenforceability, and disputes shall instead be resolved in court in accordance with Section 19.4 — but in no event will Aiua be required to participate in a class, collective, or representative proceeding.
For claims that are not subject to arbitration under this Section 19 (including IP-related injunctive relief and any claim where arbitration is found unenforceable), the parties agree to the exclusive jurisdiction of the state and federal courts located in Laramie County, Wyoming, and waive any objection to such venue.
Any claim arising out of or relating to these Terms or your use of the Platform must be filed within one (1) year after the cause of action accrues; otherwise, the claim is permanently barred.
These Terms, together with the Privacy Policy and any other documents incorporated by reference, constitute the entire agreement between you and Aiua regarding the Platform and supersede all prior agreements.
If any provision of these Terms is found unenforceable, the remaining provisions shall continue in full force and effect, and the unenforceable provision shall be modified to the minimum extent necessary to make it enforceable, preserving its original intent.
Aiua's failure to enforce any provision of these Terms shall not be deemed a waiver of that provision or any other provision.
You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms in connection with a merger, acquisition, sale of assets, reorganization, or by operation of law.
Aiua is not liable for any failure or delay in performance caused by events beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, government action, labor disputes, power or telecommunications failures, internet disruptions, or third-party-provider outages.
Notices to you under these Terms may be delivered via email to your registered address or via in-Platform notification. Notices to Aiua must be sent to [email protected] with a copy to Aiua LLC, 1603 Capitol Ave Ste 415 #239055, Cheyenne, Wyoming 82001.

These Terms do not create any agency, partnership, joint venture, or employment relationship between you and Aiua.
